China MEM Strengthens the Management of Major Hazard Source in Hazchem Enterprises

Hazardous chemicals enterprises need to appoint three safety responsible persons for each major hazard source in accordance with the Measures and disclose relevant information to the administration.

On February 4th, 2020, China’s Ministry of Emergency Management (MEM) issued the Measures for the Safety Guarantee Responsibility System for Major Hazard Installations of Hazardous Chemical Enterprises (Trial) [1], which entered into effect immediately and would be valid for 3 years.

The Measures are applicable to the hazardous chemicals manufacturers, business operators (those with storage facilities), and the chemical enterprises that use hazardous chemicals for production, who have obtained permits from MEM and involved in major hazard installations. For such enterprises, a main responsible person, a technical responsible person, and an operation responsible person shall be appointed for each major hazard installation. Responsibilities for the responsible persons are specified in the Measures. According to MEM notice, enterprises shall complete the relevant information of the person responsible for insurance through the National Hazardous Chemicals Registration Information Management System before March 31, 2021. An instructional video is available on the system now. Before April 30, 2020, enterprises shall also record relevant information at local administration of emergency management, set publicity board, and update the security risk commitment announcement.

Local administrations of emergency management shall take various supervision and inspection actions to assure the implementation of the safety guarantee responsibility system. Using the hazardous chemical safety production risk monitoring and early warning system, the administrations will strengthen online inspections and spot checks on the safe operation of major hazard installations. In addition, the administrations shall urge relevant enterprises to identify, assess, record, and withdraw major hazards, and promptly fill in information about major hazards through the hazardous chemical registration information management system.
