On September 28, 2021, China Solid Waste and Chemicals Management Center (SCC) released a list of 52 enterprises[1](involving 68 regular registration certificates) that failed to submit 2020 annual reports for their new hazardous substances with priority environmental concern registered under MEP Order No.7. Although the submission deadline was expired on April 30, SCC offers an extended period for relevant certificate holders to submit annual reports by October 31, 2021, otherwise they may face severe punishment.
2021 is the first year when the Measures for the Environmental Management Registration of New Chemical Substances (MEE Order No.12 of 2020)[2] replaced the Measures for the Environmental Management of New Chemical Substances (MEP Order No.7 of 2010)[3]. To ensure the smooth transition from the old to the new scheme, MEE published the Transitional Arrangements (ChemLinked news)[4]. According to it, this year’s annual reporting only apply to new hazardous substance with priority environmental concern that were previously registered under MEP Order No.7.
Annual reporting of registered new chemical substances has been a basic post-registration requirement in China. However, according to MEE Order 12, a majority of registered new substances will no longer be required to submit annual reports from next year. Under the new scheme, the annual reporting is only required for new substances for which the submission of an annual report is specified as an environmental management requirement in the Regular Registration Certificate, e.g. new substances of great hazards, or that are persistent and bioaccumulative, or persistent and toxic, or bioaccumulative and toxic.
