Dechlorane Plus Added to Annex I under EU POPs Regulation

The EU has amended its POPs Regulation to include Dechlorane Plus under its Prohibition List and introduced phased exemptions for specific UTC limits and critical applications.

The European Union is amending its Persistent Organic Pollutants (POPs) Regulation, specifically targeting Dechlorane Plus, a highly chlorinated flame retardant, by adding it to Part A of Annex I of Regulation (EU) 2019/1021.

The amendment, namely Commission Delegated Regulation (EU) 2025/1930, adopted on May 15, 2025 and published on September 25, 2025, introduces stringent controls on the production, placing on the market, and use of Dechlorane Plus within the EU. It shall enter into force on October 15, 2025.

As per the Annex, the following entry is added to Part A of Annex I of Regulation (EU) 2019/1021:

Concentration Limits and Phased Implementation

As per Article 3 of  Regulation (EU) 2019/1021, the manufacturing, placing on the market and use of  Dechlorane Plus, whether on their own, in mixutres or in articles shall be prohibited.

The regulation establishes unintentional trace contaminant (UTC) for Dechlorane Plus in substances, mixtures, or articles, with a phased approach to allow for industry adjustment:

Until 15 April 2028:  A transitional period allows for concentrations of Dechlorane Plus up to 1,000 mg/kg (0.1% by weight).

After 15 April 2028: allows for concentrations of Dechlorane Plus up to 1 mg/kg (0.0001% by weight).

Derogations

The regulation includes specific derogations for the placing on the market and use of Dechlorane Plus. These exemptions are time-limited and apply to specific uses:

Until 26 February 2030, derogations are granted for:

  • Aerospace, space, and defense applications

  • Medical imaging applications

  • Radiotherapy devices and installations

For spare parts and repair of the following, longer derogations are in place, applying until the end of the service life of the article or until 31 December 2043 (whichever comes earlier), provided Dechlorane Plus was initially used in their production:

  • Land-based motor vehicles

  • Stationary industrial machines used in agriculture, forestry, and construction

  • Marine, garden, forestry, and outdoor power equipment (excluding those mentioned above)

  • Aerospace, space, and defense applications

  • Instruments for analysis, measurements, control, monitoring, testing, production, and inspection

Furthermore, for medical devices and in vitro diagnostic medical devices, derogations for spare parts and repair of the following extend until the end of their service life, again contingent on Dechlorane Plus being initially used in their production:

  • Medical devices and accessories within the scope of Regulation (EU) 2017/745

  • In vitro diagnostic medical devices and accessories within the scope of Regulation (EU) 2017/746
