Japan MHLW Consults on Adjustments to Lists of Poisonous and Deleterious Chemicals

On April 28, 2020, the Japanese Ministry of Health, Labor and Welfare (MHLW) published a notice [1] to solicit comments on adjustments to the lists of poisonous and deleterious chemicals designated under the Poisonous and Deleterious Substances Control Law (PDSCL) [2], four months after the first round of consultation [3].

The details of the adjustments are shown in the table below.

Meanwhile, an adjustment was proposed for the concentration of lithium hydroxide (CAS No.: 1310-66-3) in preparations in the Deleterious Substances List, raising the threshold from 0.3% to 0.5%.

The official revision to the lists is expected to be released in mid-June and implemented in July this year. According to the PDSCL, businesses may not engage in the sale of any poisonous/deleterious substance or the manufacture/import of such substance for sales purposes unless they are registered as distributors, manufacturers or importers of poisonous/deleterious substances. Relevant businesses should also employ personnel with specialized certificates.
