On November 8, 2021, South Korea’s Ministry of Environment (MoE) published a notice to inform enterprises that the due date for application for exemption confirmation of registration of existing chemical substances ≥1000t/a or CMRs ≥1t/a under K-REACH is December 24, 2021. If on-site confirmation is needed, the exemption application shall be submitted due by November 30, 2021.
According to the phase-in implementation of existing chemical registration under the K-REACH, existing chemical substances ≥1000t/a or designated CMRs ≥1t/a shall be registered by December 31, 2021. Exemption can be applied for if any of the following conditions apply:
Substances manufactured or imported for export only;
Chemical Reagents;
Substances for R&D uses;
Surface treated substances;
Non-isolated intermediates;
Polymers of low concern (PLC).
Among these exemption conditions, (2) and (3) are eligible for exemption application within 30 days after manufacture/import. For other conditions, exemption confirmation shall be obtained before manufacture/import.
Notably, if requested to supplement data, it may take at least 14 additional days for the authority to process the application. Although there is still around a month before the deadline, it’s suggested to submit the exemption application as soon as possible to allow enough time for obtaining the exemption confirmation, ensuring the manufacture/import of these chemical substances is legal and compliant.
