Korea Mandating Voluntary Reporting on Hazards and Risks of New Chemicals Manufactured or Imported in Previous Year by 21 Nov 2015

According to Korea OSHA, anyone who intends to manufacture or import a new chemical substance should submit a review report on the hazards and risks of the substance 45 days prior to actual manufacture or import activities.

For previous cases involving non-compliance, Korea Ministry of Employment and Labor (MoEL) is now offering a chance to voluntarily submit the report. Penalties of up to 3 million Won will be waived if reporting is made successfully during the given period (6 Jul 2015 ~ 21 Nov 2015). If the deadline is missed, any violation, once disclosed or uncovered will be strictly punished. Below is the detailed information for voluntary reporting.

From 6 Jul 2015 ~ 21 Nov 2015 (about 5 months)

2. Reporting subject

New chemical substances manufactured or imported in annual volume over 0.1t before 31 Dec 2014 without previous submission of hazards and risk review reports pursuant to Article 40, Paragraph 1 of OSHA

3. How to report

The review report (Form No. 18 of Attachments of OSHA Enforcement Rules) should be posted to the Chemical Accident Prevention Division of MoEL and should include the following documentation:

  • MSDS;

  • Toxicology testing report, which can be replaced by a copy of commission contract for tests in case testing report submission within the period is infeasible;

  • Documents recording manufacture/use and the handling methods of the substance;

  • Flow chart of manufacture and use
