South Korea: 278 Existing Chemical Substance CBI Protection Expired

Note: Updated on 10 May by MoE Announcement No. 2017-91, the 278 non-toxic chemical substances were officially published with chemical names disclosed.

South Korea’s Ministry of Environment (MoE) issued the MoE Notice No. 2017-291 on 7 Apr 2017, consulting on chemical names of 278 non-toxic chemical substances. These substances applied for confidential information protection with only generic names in the past. Now the validity for data protection has expired and the chemical names have been disclosed for public reference. Any comments are welcome before 27 Apr 2017.

To protect CBI, South Korea allows enterprise to protect the confidentiality of the full chemical name of registered substances. Many substances in the current KECI are claimed confidential with only generic name listed.

According to Article 30 of K-REACH Enforcement Decree, the data protection will be valid for five years, and the registrants are allowed to apply for at most 2 applications for the data protection extension for another 5 years each. In total, 15 years can be granted for data protection.

This batch of existing chemical substances are all of non-toxic and the period of data protection has expired. The details of the substances are accessible here.
