South Korea Consults on 15 New Toxic Chemical Substances

Updated on 1 Sep by MoE Announcement No. 2017-163, the 15 toxic chemical substances (Given No. 2017-1-796~2017-1-810) were officially added into South Korea’s Toxic Chemical Substance List (TCSL).

Published on 3 Aug 2017 by MoE Notice No. 2017-564, South Korea’s Ministry of Environment (MoE) is now consulting on 2 major issues as follows: (1) supplementation of 15 toxic chemical substances (Given No. 2017-1-796~2017-1-810) into South Korea’s Toxic Chemical Substance List (TCSL); (2) their transitional measures.

Transitional measures are proposed as below:

1. The updates will be effective immediately upon approval.

2. Importers should within six months conduct importation notification according to Article 20 of Chemical Control Act (CCA).

3. Handling of these newly added toxic chemicals is subject to labeling within six months in accordance with Article 16 of CCA

4. All enterprises handling these newly added toxic chemicals or having installed and operated handling facilities for these toxic chemicals shall prepare within 2 years according to Article 23 Paragraph 1 of CCA an off-site impact analysis report that evaluates the impact of potential chemical accidents on the surrounding environment and population.

5. Manufacture, trade, storage, transport or use of these newly added toxic chemicals is subject to business licensing in accordance with Article 28 of CCA. In addition, stakeholders should comply with the requirements in terms of facilities, equipment and technical personnel qualifications, etc. within two years after the implementation of this announcement to obtain their license.

6. All enterprises handling these newly added toxic chemicals or having installed and operated handling facilities for these toxic chemicals shall comply with the standards specified in Annex 1 of CCA Enforcement Rules before 2018 and shall comply with the standards specified in Annex 5 of CCA Enforcement Rules before 2021.
