Updated on 30 Mar 2018 by NIER Announcement No. 2018-9, the updates to South Korea’s Toxic Chemical Substance List (TCSL) have been approved.
Published on 28 Feb 2018 by NIER Notice No.2018-20, South Korea’s NIER is now consulting on potential updates on the Toxic Chemical Substances List (TCSL). Any comments are welcome before 20 Mar 2018.
Proposed updates are summarized as below:
Changing “Given No. 2017-1-811~2017-1-832” to “Given No. 2018-1-811~2018-1-832” (since the substances were officially approved as toxic chemical substances in 2018)
Changing name of 9 toxic substances (Given No. 97-1-30, 97-1-31, 97-1-156, 97-1-183, 97-1-285, 97-1-334, 97-1-377, 97-1-395, 97-1-451)
Newly designating 9 toxic substances (Given No. 2018-1-833~841), which have been registered and found toxic after the hazard evaluation under K-REACH
Providing transitional measures for control of the newly designated 9 toxic substances as below:
The updates will be effective immediately upon approval.
The toxic chemical substances previously designated and published by “Designation of Toxic Chemicals, Restricted Chemicals and Prohibited Chemicals” are still regarded as toxic chemical substances according to this announcement
Importers should within six months conduct importation notification according to Article 20 of Chemical Control Act (CCA).
Handling of these newly added toxic chemicals is subject to labeling within six months in accordance with Article 16 of CCA.
All enterprises handling these newly added toxic chemicals or having installed and operated handling facilities for these toxic chemicals shall prepare within 2 years according to Article 23 Paragraph 1 of CCA an off-site impact analysis report that evaluates the impact of potential chemical accidents on the surrounding environment and population.
Manufacture, trade, storage, transport or use of these newly added toxic chemicals is subject to business licensing in accordance with Article 28 of CCA. In addition, stakeholders should comply with the requirements in terms of facilities, equipment and technical personnel qualifications, etc. within two years after the implementation of this announcement to obtain their license.
All enterprises handling these newly added toxic chemicals or having installed and operated handling facilities for these toxic chemicals shall comply with the standards specified in Annex 1 of CCA Enforcement Rules within one year and shall comply with the standards specified in Annex 5 of CCA Enforcement Rules within four years after the announcement.
NIER will review the appropriateness and make improvements every three years (counting from 1 Jul 2018.
