Taiwan Publishes Revision to Regulation of Priority Management Chemicals (Updated)

Updated:On November 5, 2021, the revision to Taiwan’s Regulations Governing Designating and Handling of Priority Management Chemicals (hereinafter referred to as Revision) was approved (Offical Gazette). The Revision took effect immediately, except for Article 6 to Article 9 which will come into force on April 1, 2022. Compared to the latest version of draft amendments (see below), there were no changes in this final revised version. 

Taiwan's Ministry of Labor (MoL) consulted on changes to the Regulations Governing Designating and Handling of Priority Management Chemicals in June 2021 (Offical Gazette), designed to tighten controls over the handling of priority management substances which may pose serious hazards to the health and safety of workers.

The regulation was promulgated on December 30, 2014 according to Article 14 Paragraph 3 of the Occupational Safety and Health Act (OSHA). It requires manufacturers, importers, suppliers, or employers to report relevant handling information of priority management chemicals to the MoL, including handler information, substance identity, quantity, use, exposure scenarios, etc.

In a major change, the draft revisions update the categories of priority management chemicals and their corresponding thresholds. As proposed, the priority management chemicals will be:

  1. Chemicals hazardous to person under the age of 18, or pregnant women, or a female employee who is still within her first postpartum year, as specified in Appendix 1 of the Regulation (no change);

  2. Chemicals classified according to the Taiwan CNS 15030 standards as CMRs, or possessing hazards of Category 1 respiratory sensitization, Category 1 serious eye damage/eye irritation, or Category 1 specific target organ systemic toxicity- repeated exposure with the content (w/w) and annual handling quantities for any type of operation reaching the thresholds as specified in Appendix 2 (newly added), and designated and published by the central competent authority;

  3. Chemicals classified according to the Taiwan CNS 15030 standards possessing physical hazards or health hazards with the maximum handling quantities reaching the thresholds as specified in Appendix 3 (currently the Appendix 2, partially updated), and designated and published by the central competent authority;

  4. Others designated and published by the central competent authority. 

Other amendments are:

l  Updating the form for basic information of handlers and the form for handling information;

l  Adding definitions of handling, handler, disposal, and maximum handling quantities;

l  Updating the due date for reporting;

l  Offering grace period for implementation of the revisions.
