Taiwan Revises Regulations for Priority Management Chemicals [Updated]

The amendments include provisions to increase the frequency of reporting, introduce dynamic reporting, and strengthen the submission of essential information by operators, etc.

On June 6, 2024, Taiwan’s Ministry of Labor (MOL) published the revised Regulations for Governing Designating and Handling of Priority Management Chemicals (hereinafter referred to as the Regulations), with some structural adjustments and editorial changes compared to its proposed draft. The Regulations came into effect immediately.

Since its initial publication on December 30, 2014, the Regulations were last revised and published on November 5, 2021. This revision aims to enhance the monitoring of chemical operations at factories, particularly for chemicals with acute hazards and quantities exceeding certain thresholds. By enhancing the frequency and timeliness of reporting, the proposed amendments seek to improve the effectiveness of data and facilitate the administrative assistance of relevant authorities in accident prevention and response.

Proposed draft in March 2024


On March 26, 2024, Taiwan’s Ministry of Labor (MOL) proposed amendments to the Regulations for Governing Designating and Handling of Priority Management Chemicals (hereinafter referred to as the Regulations). Public comments are welcome before April 25, 2024.


The key points of the proposed amendments are as follows:


Definition of “Maximum aggregate operating quantity” (Article 3)

The definition of “Maximum aggregate operating quantity” refers to the maximum quantity of chemicals present in an operating site at any given time.


First-time reporting deadline (Article 7)

The first-time reporting deadline for operators with fewer than 100 workers will be shortened from 18 months to 12 months, and operators will need to provide their company's unified identification number and factory registration number for enhanced data cross-referencing.


Reporting frequency (Article 8)

The reporting frequency for highly hazardous priority management chemicals, such as flammable, explosive, or acutely toxic chemicals, will be updated to every six months instead of annually.


Dynamic reporting requirements (Article 8)-removed to Article 9 in the final verison

Operators exceeding the previously reported "Maximum aggregate operating quantity" and reaching the specified threshold as specified in Appendix 3 will have to engage in dynamic reporting, with a requirement to report within 30 days from the occurrence of such an event.
