Update: On April 1, 2022, Taiwan Ministry of Labor issued a document of frequently asked questions and answers regarding the notifications and reports of priority management chemicals under the Regulation Governing Designating and Handling of Priority Management Chemicals. It is a supporting document for the Regulation, which includes 27 questions. The original file can be accessed here.
On February 14, 2022, Taiwan Ministry of Labor released the amendments to the List of Designated Priority Management Chemicals in accordance with the Article 2 of the revised Regulation Governing Designating and Handling of Priority Management Chemicals. The amendments will come into effect on April 1, 2022.
The revised Regulation Governing Designating and Handling of Priority Management Chemicals (hereafter referred to the Regulation) was issued on November 5, 2021 (CL news), which updated the categories of priority management chemicals in its Article 2 including:
Article 2(1) Chemicals hazardous to workers under the age of 18 and to pregnant female workers or who are within their first postpartum year;
Article 2(2) Chemicals classified according to the Taiwan CNS 15030 standards as carcinogenic, mutagenic or toxic for reproduction (CMRs), or possessing Respiratory Sensitizer Category 1, Serious Eye Damage/Eye Irritation Category 1, Specific Target Organ Toxicity (repeated exposure) Category 1;
Article 2(3) Chemicals classified according to the Taiwan CNS 15030 standards possessing physical hazards or health hazards and designated and published by the central competent authority;
Article 2(4) Other chemicals designated and published by the central competent authority.
The newly published amendments to the list of designated priority management chemicals are aimed at re-categorizing the previously designated chemicals (published in 2015 and 2018 for phased-in implementation) in line with the updated categories as per Article 2(2) and Article 2(3).

Remove 23 chemicals
Compared with the previously published priority management chemicals, 23 chemicals are removed due to their GHS classification (with reference to the international public database) or to avoid duplicative chemical management with other laws and regulations.

Re-categorize the left 1,052 chemicals
The left 1,052 chemicals are re-categorized and listed into two Annexes, include:
Annex 1: 889 priority management chemicals designated as per Article 2(2) of the Regulation, and mixture containing over 1% (w/w) of such chemicals;
*Note: According to the Appendix 2 of the Regulation, chemicals possessing CMR, Cat.1, they are subject to priority management regardless of the annual handling quantities However, for chemicals possessing other hazard categories listed in Article 2(2), they are only subject to control if the annual handling quantities reaching 1 tonne.
Annex 2: 163 priority management chemicals designated as per Article 2(3) of the Regulation, and mixtures containing such chemicals
*Note: these chemicals are subject to priority management if the maximum handling quantities reaching the thresholds as specified in Appendix 3 of the Regulation.
