Taiwan to Update Toxic Chemical Substance List

Taiwan EPA will update the Toxic Chemical Substance List and tighten the management on some POPs. A grace period is offered to allow stakeholders to prepare for compliance with new requirements.

In response to international management trends of persistent organic pollutants (POPs), Taiwan EPA proposed to update the Toxic Chemical Substance List on May 19, 2020.

The proposed updates include:

1. Change the term “large-scale handling standard” to “graded handling quantity” in accordance with the Toxic and Concerned Chemical Substances Control Act (TCCSCA)[1] Article 11 Paragraph 2;

2. Designate Dicofol (CAS: 115-32-2; 10606-46-9) as Class 1, 3 toxic chemical due its bioaccumulation and ecotoxicity, providing the graded handling quantity as “50” and control concentration standard (w/w %) as “1”;

3. Regulate Perfluorooctane sulfonyl fluoride (CAS: 307-35-7) and Perflurooctanoic acid (PFOA) (CAS: 335-67-1) more stringently from Class 4 to Class 1 toxic chemical, change the graded handling quantity and the control concentration standard (w/w %) accordingly;

3. Tighten the control concentration standard (w/w %) on Lithium perfluorooctane sulfonate (CAS: 29457-72-5) from “1” to “0.01”;

4. Update the chemical name and CAS number of Tetrabromodiphenyl ether; update the CAS number of Pentabromodiphenyl ether;

5. Update the prohibitions and allowed uses for these toxic chemicals and provide transitional period.

The EPA has conducted an investigation on the use of these substance and found they are mainly used for research, experiment and education. Therefore, the tightened regulation of these substances may have limited impact on the industry.
