On 12 Feb 2018, Taiwan’ Environmental Protection Administration (EPA) proposed to list more substances as toxic chemical substances. The potential updates are detailed as below, which is subject to a period of public consultation lasting 60 days.
(1) Adding toxic chemical substances
Pentachlorophenyl laurate will be regulated as both a Class 1 and 3 toxic chemical substance. It will be forbidden for manufacture, import, sale and use, except for research, testing and educational uses. Perflurooctanoic acid (PFOA) will be regulated as Class 4. Their control concentration are specified as 0.01%. These two substances are persistent organic pollutants that are not easily decomposed. Pentachlorophenyl laurate has been controlled by the Stockholm Convention and PFOA is proposed to be listed in the Stockholm Convention. Thus Taiwan EPA in response to international management trends proposed to tighten regulation of these substances.
In addition, Sudan 1 and other 13 pigment substances will be added into the TCSL and regulated as Class 4 toxic chemical substances with control concentration specified as 1%. These pigment substances which are for industrial use are illegally used as food additives which poses considerable risks to human health. For food safety concern, the authority this time listed them as toxic chemical substances. "Not for use in foods and feeds" must be marked on their container packaging. The labeling area shall not be less than 35% of the area of the container or the outer packing area. The color of the words on label should be in contrast with the background color.
(2) Revising control concentration
In addition to adding substances, Taiwan authority also revised the regulated control concentration of one previously designated toxic substance (Perfiuorooctane sulfonic acid). The concentration threshold is proposed to be lowered from 1% to 0.01% in this revision.
(3) Providing control measures and transitional period
Control measures have been provided for the above mentioned toxic chemical substances in terms of substances handling, release quantity recording, transportation, etc. For example, the recording and regular notification of toxic chemicals handling and release quantity shall start on 1 Jul 2018.
