Thailand Customs Inspection Authority to Issue Notes for New Type 3 Chemicals

The 4th edition of Thailand’s List of Hazardous Chemicals was published on Jan 11th, 2018 and took effect on the next day. In this latest edition of the List, 23 types of chemicals were added to the list, which are regulated by the Department of Industrial Works (DIW). The newly added chemicals were all classified as Type 3 chemicals and subject to specific compliance duties including notification, registration, and application for a license. Recently, DIW clarified some confusions that enterprises encountered during the import and export of the newly added hazardous chemicals:

  1. For the chemicals purchased before the effective date of the 4th edition of the List of Hazardous Chemicals i.e. Jan 12th, 2018, enterprises don’t need to follow the regulatory requirements on Type 3 chemicals during import or export, as long as enterprises can provide an invoice of the sales.

  2. Within 30 days of the effectiveness of the 4th edition of the List, which is from Jan 12th to Feb 10th, 2018, DIW will issue a note to any enterprise applying for a license to import or export the newly added Type 3 chemicals, as an evidence of the application. If the newly added chemicals are imported after Jan 12th and held up by Thailand Customs, then the importing enterprise could show this evidence note to the Customs officials and prove that the application for license is being processed. However, the imported chemicals will not be cleared by the Customs until the application for license is finished.
