The deadline for nominating chemicals into Thailand’s 1st version of the national chemical inventory through Annex 5.6 notification is Dec 31st, 2016. As the deadline approaches, Thailand Department of Industrial Works (DIW) has received a huge amount of queries regarding notification. One of the most frequently asked question relates to the protection of confidential business information (CBI). In those inquiries, many manufacturers provided incomplete data, which caused repeated check and verification by DIW and resulted in very slow progress. To make things clear for the enterprises and save time for both industry and the authority, DIW issued an announcement and further specified some requirements related to CBI procedure as follows. CBI data must be provided by the manufacturer, or some responsible person authorized by the manufacturer. In addition, the product name and SDS must conform to those in the consultation letter. 100% composition information including CAS numbers and substance names must be provided. However, structural formula and substance name are accepted for substances without CAS numbers.
There are two ways for DIW to confirm the submission number and submission date when manufacturer provide CBI to DIW:
A manufacture can provide the first page of the consultation letter of his importer.
A manufacture can provide the name of the importer who submitted the consultation letter, along with the submission number and date that DIW gave the importer.
CBI data provided by the importer won’t be accepted and reviewed by DIW even if the importer has already applied for CBI process online and submitted the consultation letter to DIW. In this case, DIW will automatically treat it as a regular Annex 5.6 notification and won’t go through the CBI process.
These requirements took effect on Dec 1st, 2016.
