Thailand to Regulate Dechlorane Plus and UV-328 as Type 3 Hazardous Substances

If adopted, licensing requirements will be imposed on companies involved in the import, export, production, possession, and transit of these chemicals in Thailand.

On December 2, 2024, Thailand DIW initiated a public consultation on the proposal to list several persistent organic pollutants (POPs) in Annex 5.1 of the Hazardous Substances List. Involved POPs include:

  • Dechlorane Plus (CAS No. 13560-89-9)

  • Syn-Dechlorane Plus (CAS No. 135821-03-3)

  • Anti-Dechlorane Plus (CAS No. 135821-74-8)

  • UV-328 (CAS No. 25973-55-1)

They are proposed to be regulated as Type 3 hazardous substances under Thailand’s Hazardous Substances Act B.E. 2535 (1992). If adopted, licensing requirements (e.g., HS Registration and HS Permit) will apply. The consultation period will be due by December 16, 2024.

Background

Thailand ratified the Stockholm Convention on Persistent Organic Pollutants (POPs) on January 31, 2005. At the 11th Conference of the Parties (COP) to the Stockholm Convention, held in May 2023, decisions were made to amend Annex A (Elimination) by adding three chemicals: 1) Dechlorane Plus, 2) UV-328, and 3) Methoxychlor. Notably, Dechlorane Plus includes both its syn-isomer and anti-isomer as outlined in the decision SC-11/10.

The listing requires Parties to eliminate the production and use of these chemicals. To fulfill Thailand's obligations under this international convention, the DIW recently proposed to regulate Dechlorane Plus and UV-328 as Type 3 hazardous substances in Thailand.
