China Imposes Special Inspection on 35 Hazardous Substances, Reinforcing Law Enforcement

The Chinese Ministry of Emergency Management (MEM) recently released the 2023 work plan for the special inspection on safety management of 35 hazardous chemicals (Hazchem) throughout their manufacture, import, operation and use, focusing on the implementation status of the following obligations:

  • Hazchem registration;

  • Labeling;

  • Safety data sheet (SDS); and

  • Hazard identification and classification, etc.

Enterprises that manufacture, import, and operate the 35 target hazardous chemicals are subject to this special inspection, as well as enterprises that have obtained Hazchem Use Permits of them. The inspection items differ due to the type of enterprises as the table below illustrates. Penalties (e.g., revocation of relevant permits) will apply if enterprises violate any relevant regulations and laws.

Enterprises that have obtained the Hazchem Use Permit

  1. Whether or not the Hazchem registration information is complete

  2. Label and SDS

  3. Hazard identification and classification

Detailed Schedule

By the end of August 2023

The authorities will comprehensively Inspect the implementation status of obligations to the abovementioned target enterprises and retrospectively check the clues of illegal behaviors. Spot checks will be carried out on other aspects in the Hazchem safety management, e.g., storage. For detected and verified violations, administrative penalties will be imposed on involved enterprises.

By the end of October 2023

Through the spot checks carried out on these enterprises, the authorities will strengthen the supervision and verify the implementation status of their obligations, as well as provide the corresponding compliance guidance.

By the end of November 2023

The authorities will develop a report to summarize the effect of special inspection and law enforcement.
