SCC-MEP has updated the software for annual reporting of new chemical substances. Compared to the previous version (issued in 2012), the data required for this year has been simplified, most notably in changes made to the annual report template attached as Annex 4 in the draft of the revised China New Chemical Substance Notification Guidance (hereafter referred to as the draft Guidance). It will greatly reduce the associated compliance work of certificate holders.
The certificate holders of simplified notification and regular notification (hazardous new chemical substance and hazardous new chemical substances of priority environmental concern) are obliged to submit annual report to the SCC-MEP. The submission of the annual report detailing manufacture or import activities in the year of 2015 is due by the 1st of Feb 2016.
SCC-MEP will undertake review work and certificate holders are required to make corrections within the allotted time. Failure to meet requirements will be equivalent to non-submission of an annual report and authorities will punish violators by publicizing the violation and imposing a fine of RMB 10,000.
According to the draft Guidance, the definition of certificate holders will be modified. At present the local representative agent (similar to OR under EU REACH) based in China is the certificate holder if the notifier is a non-Chinese company. However, in the draft Guidance the notifier will be the certificate holder (regardless of geographical location), which means when the draft is finalized international notifiers based outside of China will be responsible for submission of the annual report rather than the local representative agent based in China. For 2015 annual reporting the Chinese representative is still tasked with submission of the annual report.
