On May 9, 2023, Thailand’s Department of Industrial Works (DIW) published in the Royal Gazette the revised regulation – Safety Measures for Chemical Management in Industrial Plants (No. 2) B.E. 2566 (2023) (hereinafter referred to as the Regulation).
Background
This Regulation was developed under Thailand’s Factory Act B.E. 2535 (1992) to strengthen the chemical safety management in industrial plants that may use or store large quantities of hazardous chemicals, ensuring precautionary measures have been implemented. Its previous version was approved on March 1, 2022, made public in the Royal Gazette on April 25, 2022, and took effect on October 22, 2022. The updates this time are regarding Article 7 and Article 42, which stipulate requirements for annual reporting.
Updates
Previously, industrial plants, which are of certain types listed in the annex of the Regulation (see Pages 10 ~13), are required to report the information on the use and storage of each hazardous chemical (over 1 t/y) in a calendar year before April 1 of the following year. That’s to say, the 2022 report should be submitted before April 1, 2023. However, as per the revised Regulation, grace periods are provided for the annual reporting of 2022.
Before August 31, 2023: Industrial plants of the types that are listed in the annex, e.g., oil refineries; chemical plants involving production of metal polish, disinfectant or deodorant, factories producing synthetic resin rubber, etc., should submit the annual report of 2022 to the DIW.
Before October 1, 2024: Industrial plants of the types that are not listed in the annex should submit the annual report of 2022 to the DIW.
They shall be prepared in the required form attached to the regulation (see screenshot below) and submitted electronically via the DIW online system. Besides, the annual report for each calendar year after 2022 should be submitted by April of the following year.

The abovementioned updates were approved on April 5, 2023, and came into force on April 20, 2023. Recently, they were made public in the Royal Gazette.
