China Implements New Provisions on Road Transport of Dangerous Goods

By a circular issued on December 4, 2023, the Chinese Ministry of Transport (MoT) announced the revised Provisions on the Administration of the Road Transport of Dangerous Goods (hereinafter referred to as the Provision), which took effect immediately. The Provision was initially issued on July 12, 2005, and has undergone four subsequent revisions, in 2013, 2016, 2019, and 2023. Its most recent revision was adopted on November 10, 2023, and has been recently made public.

Major updates

  • Abolishing the fine for road transport enterprises or units that fail to carry the License for Road Transport of Dangerous Goods onboard as required, to align the Provision with its superior law - Work Safety Law of the People's Republic of China.

  • Updating the referenced standards appropriately, based on the revision and abolition of certain standards in the past two years, more specifically:

  1. Dangerous goods in the Provision refer to those listed in JT/T 617 Regulations concerning Road Transportation of Dangerous Goods (rather than GB 12268 List of dangerous goods).

  2. The classes and divisions, names and UN numbers of dangerous goods shall adhere to JT/T 617 (rather than GB 6944 Classification and code of dangerous goods and GB 12268).

  3. The hazard level of dangerous goods shall be assigned to I~III in accordance with JT/T 617 (rather than GB 12463 General Specifications for Transport Packages of Dangerous Goods).

  4. Any person engaged in the road transport of dangerous goods shall operate under JT/T 617 (rather than JT 617 The Provision of automobile transportation of dangerous goods and JT 618 Rules of transportation, loading and unloading of dangerous goods by automobile, which have been abolished in 2019).

  • Updating the names of certain competent authorities accordingly due to the national institutional reform deployment in 2018.
