Global Chemical Regulation Highlights | October 2023

In October of 2023, China released the Inventory of Severely Restricted Toxic Chemicals (2023). South Korea proposed amendments to both TSCL and GHS classification list. Japan consulted on designating NPE as Class II Specified Chemical Substances under CSCL. Australia considered listing short chain chlorinated paraffins (SCCPs) in IChEMS Register Schedule 7. Officials at ChemCon Europe signaled that the formulation of India REACH Regulation may be shelved for some years to come.

China

 

By a circular issued on 18 October 2023, the MEE released the Inventory of Severely Restricted Toxic Chemicals (2023), adopting the updates proposed in June. It took effect immediately to replace the 2020 version. If enterprises intend to import or export any of the listed chemicals, they shall apply for the Clearance Notification for Environmental Management on Import/Export of Toxic Chemicals to the MEE, which, upon being verified, shall be submitted by the importer/exporter to the Customs to complete the formalities for import and export. On October 4, 2023, South Korea's NIER issued two notices to seek public comments on the amendments to the Toxic Chemical Substances List (TCSL) and the GHS Classification List. The public consultations will end on October 23, 2023.  (Read more)

Australia, New Zealand and Singapore

 

Australian Government is currently consulting on listing short chain chlorinated paraffins (SCCPs) in IChEMS Register Schedule 7. If adopted, stringent risk management measures will apply. Comments are welcome before November 8, 2023. This proposed scheduling decision is expected to take effect on July 1, 2024. (Read more)

India, Vietnam, Thailand and Turkey

 

Speaking at ChemCon Europe on October 26, 2023, Mr. Kumaresh C Misra, the director of India Chemical Council, highlighted the immense chanllenges faced by the government to finalize the "India REACH", which serves as an umbrella Act for chemical management in India. He added that the prospect of an upcoming REACH regulation will depend on the big election next year when there is a stable environment that would allow the government to focus more on chemical management. (Read more)

European Union and United Kingdom


ECHA has received a mandate from the European Commission to prepare an Annex XV report for possible restriction of at least the chromium (VI) substances that are currently in entries 16 and 17 of the REACH Authorisation List (Annex XIV). ECHA will submit the proposal by 4 October 2024. (Read more)

North America

 

On October 11, 2023, the USA’s Environmental Protection Agency (EPA) published a finalized rule to require reporting and recordkeeping for per- and polyfluoroalkyl substances (PFAS) under the Toxic Substances Control Act (TSCA). This rule builds on over two years of progress on the Biden-Harris Administration’s action plan to combat PFAS pollution, safeguarding public health and advancing environmental justice, and is a key action in EPA’s PFAS Strategic Roadmap. It shall be effective on November 13, 2023. (Read more)
