China
The Chinese Ministry of Ecology and Environment (MEE) opened a public consultation on the Technical Specification of Nomenclature of Chemicals for Environmental Management (Draft). The purpose of this document is to standardize the nomenclature of chemicals, which will better support new chemical registrations, the management of existing chemicals, environmental risk assessment and the control of chemicals. South Korea
On May 5, 2023, South Korea’s Ministry of Environment (MoE) issued a notice to seek public comments on the updates to South Korea’s Existing Chemical Substance Inventory (KECI). The authority proposed to disclose the chemical name of 210 substances, which previously applied for confidential information protection with only generic names and their data protection validity has expired. Any comments are welcome before May 24, 2023. (Read more)

Japan's Ministry of Health, Labor and Welfare (MHLW) has recently made changes to the list of deleterious substances designated under the Poisonous and Deleterious Substances Control Law (PDSCL). The amendment, which was published on May 26, 2023, includes the following changes:

Australia
In May 2023, the AICIS issued two notices to announce the updates to Australian Inventory of Industrial Chemicals (AIIC). The CBI approval for the proper names of two industrial chemicals in the AIIC were revoked. Two chemicals have been added to the AIIC as their assessment certificates do not include a condition on the period for which these industrial chemicals are permitted to be introduced, therefore, they could be listed into AIIC even if 5 years have not yet passed since their assessment certificates were issued. Thailand
On May 9, 2023, Thailand’s Department of Industrial Works (DIW) published in the Royal Gazette the revised regulation – Safety Measures for Chemical Management in Industrial Plants (No. 2) B.E. 2566 (2023). The updates this time are regarding Article 7 and Article 42, which stipulate requirements for annual reporting. As per the revised Regulation, grace periods are provided for the annual reporting of 2022. (Read more) |
India In a draft notification published in the Gazette of India on May 2, 2023, India's Ministry of Environment, Forest and Climate Change (MoEF) proposes to bring out regulation for extended producer responsibility (EPR) for used oil. Once passed, it shall take effect on April 1, 2024. Public and other stakeholders have 60 days from the date of publication to comment on the proposal. | Vietnam On May 11, 2023, MOIT published the second draft amendment of the Decree No.38/2014/ND-CP for public consultation. The Draft was open for comments until May 31, 2023. The latest draft consists of 6 chapters, 43 articles. It proposes to amend and supplement provisions on the production, trading, storage, use, import and export of Schedule chemicals, declaration and inspection of Schedule chemicals and the list of Schedule chemicals. European Union, United Kingdom and Turkey On May 8, 2023, European Commission announced in the official journal to amend Annex XVII to Regulation (EC) No 1907/2006 (REACH Regulation), seeking to restrict the placing on the market or use of lead and its compounds in polymers or copolymers of vinyl chloride (PVC). The Amendment is set to enter into force on May 28, 2023. (Read more)

| South America
On May 9, 2023, Brazil’s Constitution, Justice and Citizenship Commission (CCJC) approved the National Chemical Law (PL 6120/19). The Bill will now be submitted to Senate for consideration. Once passed, the Bill will serve as the Brazil REACH Regulation and make Brazil the third country in South America to establish a chemical management law after Chile and Colombia. As per the Bill, Brazil will set up a National Inventory of Chemical Substances (Inventory) to consolidate an information base on chemical substances with hazardous characteristics in accordance with GHS. On May 20, 2023, Canada’s Environment and Climate Change Canada (ECCC) published a Draft State of Per- and Polyfluoroalkyl Substances (PFAS) Report and a Risk Management Scope for PFAS in the Canada Gazette. The Report assesses the potential impacts of PFAS substances on the human health and environment. The Risk Management Scope for PFAS outlines the proposed risk management options under consideration and gathers information to identify and prioritize options for minimizing exposure to PFAS. Global - International Conventions POPs Convention listed DP and UV-328 in Annex A for Global Ban At the 11th Conference of the Parties (COP) to the Stockholm Convention held from 1 to 12 May, 2023, delegates representing 180 countries took important decision to list three persistent organic pollutants (POPs), namely the pesticide methoxychlor and the industrial chemicals Dechlorane Plus and UV-328 in Annex A to the Convention. The listing will require Parties to eliminate the production and use of these chemicals. (Read more) |
