Global Chemical Regulation Highlights | September 2024

In September of 2024, China initiated revision to GB 15258 to incorporate QR code requirements for GHS label preparation. Japan proposed to add 155 substances subject to mandatory GHS compliance. South Korea provided the public a more comprehensive list of controlled POPs. Vietnam finalized the draft Law on Chemicals. Thailand opened public consultation on the updates to the List of Hazardous Substances. Australia proposed to prohibit HCB, PCBs, PCTs from import, export, manufacture and use. EU added PFHxA, its salts and related compounds to the Restriction List under REACH with specific exemptions.

China


On September 14, 2024, China’s State Administration for Market Regulation (SAMR) opened a public consultation on project to revise GB 15258-2009 General Rules for Preparation of Precautionary Label for Chemicals. This initiative aims to address the two key issues. One is to ensure that the hazard classification and precautionary statements are consistent with the latest version of UN GHS. The other is to meet the needs of national safety supervision of hazardous chemicals through the “One Enterprise, One Chemical Product, One QR Code” policy, enhancing hazard information communication. Japan, South Korea and India


Japan’s Ministry of Health, Labour and Welfare has announced plans to host a public meeting on September 20, 2024, to gather stakeholder opinions on expanding the list of substances subject to mandatory labeling and Safety Data Sheet (SDS) requirements under the Industrial Safety and Health Law (ISHL). Changes to Schedule 2 of the Ordinance on Industrial Safety and Health, which will include the addition of 155 substances and the removal of 2 substances. (Read more)

Thailand, Vietnam and Australia

 

Thailand’s Ministry of Industry recently opened a public consultation to solicit comments on the proposed updates to the List of Hazardous Substances under the Hazardous Substances Act B.E. 2535 (1992). For industrial chemicals regulated by the DIW, the proposed updates target the control of cyanide compounds. Their hazard types or control conditions are to be adjusted for stricter management. European Union and United Kingdom


On September 20, 2024, the European Commission announced to add Undecafluorohexanoic acid (PFHxA), its salts and PFHxA-related substances to the Restriction List under REACH (Annex XVII to Regulation (EC) No 1907/2006).  This amendment was published in the Commission Regulation (EU) 2024/2462 in the Official Journal of the European Union. It will come into force on October 10, 2024. (Read more)

 

More regulation highlights in EU and UK:


North America


On September 5, 2024, EPA took direct final action to amend the TSCA Regulation with reporting and recordkeeping requirements for PFAS. The beginning of the data submission period is modified from November 12, 2024 to July 11, 2025, with a corresponding change to the end of the submission period. EPA is also making a technical correction to address an error in the regulatory text. There are no other changes to the reporting and recordkeeping requirements in the existing rule under TSCA.
