On November 30, 2021, Colombia released the Decree 1630 of 2021, which establishes a comprehensive framework for management of chemical substances for industrial use, including their risk management. The Decree shall enter into force on the same date of its publication. 

1. Exemption

This Decree shall not appy to the following chemical substances for industrial use:

  1. Those chemical substances that have a specific regulation for their use, as well as those that in the future will have such regulation [e.g., pesticides, cosmetics, cleaning products, food additives, etc.]

  2. Substances of unknown or variable composition, complex reaction products or biological materials – UVC

  3. Articles.

  4. Impurities.

  5. Substances of natural origin without chemical processing.

  6. Substances that result from a chemical reaction as a consequence of exposure to environmental factors (air, humidity, sunlight, microbial organisms) or from storage of another product, during the end use of other products that have not been manufactured, imported or marketed as such.

  7. Substances that are not manufactured, imported or marketed as such resulting from a chemical reaction.

  8. By-products that have not been imported or marketed as such.

  9. Hydrates of a substance or hydrated ions.

  10. Polymers, including monomeric units and additives that are part of the polymers.

  11. Substances in customs transit.

  12. Non-isolated intermediates.

  13. Samples of no commercial value. 

2. Registration 

2.1 Registration information

Manufacturer or importer of hazardous substances or mixtures in quantities above 100kg/yr shall notify the following information via the online registration system: 

  1. Identification data of the manufacturer or importer of the chemical substance;

  2. Annual production or import quantity of the chemical substance;

  3. Identification of the chemical substance, including CAS number;

  4. GHS Hazard classification;

  5. Identified uses.

The registration shall be conducted online in Spanish. Registrants need to provide a Colombian taxpayer identification number to access the online registration system, thus foreign manufacturers shall seek assistance from local importers or appoint an Only Representative (OR) to fulfil the obligations. 

2.2 National Inventory 

The first deadline for notification is May 30, 2025. After the prescribed deadline, the first National Inventory of Chemical Substances for Industrial Use will be created by the official. 

The National Inventory is a database of information on chemical substances produced or imported in the national territory that allows for the identification of each substance with the quantities manufactured or imported, the identified uses and the dangerousness.

If your chemical substances are not registered before May 31, 2025, they will be considered new chemical substances, which when exceeding the quantities of 100kg/yr, the importer or manufacturer will have a maximum period of six(6) months to notify the required information. They are also required to update information produced or imported substances online once a year. 

3. Prioritization and Risk Assessment

The instrument for prioritizing chemical substances is included in the National Inventory, the Ministry of Environment and Sustainable Development, Ministry of Health and Social Protection, and Ministry of Labor, based on the information obtained from the National Inventory, shall define the criteria and conditions that allow for the identification of substances that are considered priority or of interest to health or the environment, for which additional detailed or specific information will be required to allow for decision-making for their comprehensive management.

For new industrial chemical substances that meet the critieria and conditions to be considered of priority or of interest to health or the environment, the importer or manufacturer must perform envrionmental or health risk assessment for this substance in accordance with guidelines prepared by the Ministry of Environment and Sustainable Development.
